HC refuses to quash chargesheet against Kanpur CMO

Lucknow: The Lucknow bench of Allahabad high court has refused to quash chargesheet and appointment of inquiry officer in a departmental proceeding against Kanpur CMO Dr Hari Dutt Nemi, who came in the news after a dispute with Kanpur district magistrate. “This court does not find any good ground to grant indulgence. The petition therefore fails and is dismissed at the admission stage itself,” said the court. A bench of Justice Manish Mathur passed the order on the petition of Dr Nemi who had challenged the chargesheet issued to him on July 9 and appointment of the inquiry . It was argued that the chargesheet was prepared first and the inquiry officer was appointed later. It was also said that the court had stayed the suspension of the petitioner on July 7 after which when he went to join his post, the district administration and police officials created a ruckus and obstructed his joining, regarding which a contempt petition has been filed, which is pending . It was said that the chargesheet has been sent against him with this ill intention. Opposing the pleas, it was said that the departmental inquiry had been initiated as per rules and the petitioner has not been able to prove as to what malicious intent was visible in the action taken by govt against him. tnn
